My application got refused. Can I take it to appeal?

Depending on the reason(s) why the application got refused, it might be reasonable to take it to appeal. We can review the decision and the officer’s report to see whether there is an opportunity to appeal against the authority.

If they have not issued a decision within 8 weeks for non-major applications, 13 weeks for major applications or 16 weeks for applications subject to an environmental impact assessment, you are entitled to appeal against non-determination of the appeal. The timescales as stated by the Planning Inspectorate’s performance targets are:

Written Representations – 80% of appeals within 14 weeks

Hearings – 80% appeals within 14 weeks

Inquiries (non-bespoke) – 80% appeals within 22 weeks

The type of appeal to submit would depend on the reasons for refusal and the type of application and proposal. We would assess the application and recommend the best route.

Written Representations – this is the most common and simplest method of appealing a planning decision, where an inspector considers written evidence from all parties involved, including the appellant, the local planning authority, and others with an interest, without a formal hearing or public inquiry. 

Informal Hearing – An informal allows parties to present oral evidence and discuss a matter, often led by an inspector in a round-table discussion format. 

Public Inquiry – is a more formal procedure than the informal hearing route and is usually used for complex cases where legal issues may need to be considered. The main parties will usually have legal representatives to present their case and to cross-examine any witnesses.
